This paper unravels the diverse strands in the manifestations of the Prevention of Terrorism Act (POTA, 2002), focusing not only on law’s words, i.e. the rules, principles and procedures, and its interpretations in judgments, but also on its effects. Adopting the violence of jurisprudence approach, it eschews the dichotomy between law and violence, examining the ‘effects of legal force’, in particular, the ways in which law becomes an integral part of the organization of state violence. Through an examination of the (...) unfolding of POTA and laws dealing with ‘organized crime’ and ‘unlawful activities’ (Unlawful Activities Prevention Act, 1967, 2005), the trajectory of specific cases and judgments by Trial Courts, the High Courts and the Supreme Court, this paper shows how through an interlocking of the ordinary and extraordinary, anti-terror laws erode both the procedural and substantive aspects of the rule of law, become the terrain where permutations in alliance politics and configuration of power are played out, and assume an antagonistic notion of politics which seeks resolution through the elimination and externalization of difference. Extraordinary laws, it argues, are manifestations of a politics of negation. Processes that prolong the lives of such laws, and procedural interlocking and intermeshing that seek to give them permanence, are symptomatic of a deepening of the politics of negation. (shrink)

The present attempt to introduce the general philosophical reader to the Phenomenological Movement by way of its history has itself a history which is pertinent to its objective. It may suitably be opened by the following excerpts from a review which Herbert W. Schneider of Columbia University, the Head of the Division for Internc.. tional Cultural Cooperation, Department of Cultural Activities of Unesco from 1953 to 56, wrote in 1950 from France: The influence of Husser! has revolutionized continental philosophies, (...) not because his philosophy has become dominant, but because any philosophy now seeks to accommodate itself to, and express itself in, phenomenological method. It is the sine qua non of critical respectability. In America, on the contrary, phenomenology is in its infancy. The aver age American student of philosophy, when he picks up a recent volume of philosophy published on the continent of Europe, must first learn the "tricks" of the phenomenological trade and then translate as best he can the real import of what is said into the kind of analysis with which he is familiar....... No doubt, American education will gradually take account of the spread of phenomenological method and terminology, but until it does, American readers of European philosophy have a severe handicap; and this applies not only to existentialism but to almost all current philosophicalliterature. Julietta Singh challenges the drive toward the mastery over self and others by showing how the forms of self-mastery advocated by anticolonial thinkers like Fanon and Gandhi unintentionally reproduced colonial logic, thereby leading her to argue for a more productive human subjectivity that is not centered on concepts of mastery.

In this commentary, I raise a few questions about Schmidt’s argument against (R-E): whether facts about incoherence are directly reasons for suspension on particular propositions, as opposed to reasons against sets of attitudes; whether (R-E) should really be formulated in terms of a broad category of “doxastic attitudes” that includes transitional attitudes like suspension; and whether incoherence-based reasons really must fit into the category of “epistemic reasons,” as opposed to be a more general category of right-kind reasons. Though my questions (...) reflect some skepticism about the specifics of Schmidt’s argument, I conclude that it succeeds in what I take to be its broader aim. (shrink)

Our concern in this paper lies with a common argument from racial discrimination to realism about races: some people are discriminated against for being members of a particular race (i.e., racial discrimination exists), so some people must be members of that race (i.e., races exist). Error theorists have long responded that we can explain racial discrimination in terms of racial attitudes alone, so we need not explain it in terms of race itself. But to date there has been little detailed (...) discussion of whether it is better to explain racial discrimination in terms of race or in terms of racial attitudes alone. Our goal is to offer a novel and detailed argument in defense of explaining racial discrimination in terms of racial attitudes alone, by attending to the neglected phenomenon of misperception discrimination, which involves differential treatment due to misperceived race. We argue that the discriminatory action in misperception cases must be explained in the same way as cases where (according to the realist) the victim’s race is accurately perceived. Thus, the victim’s actual race cannot provide the best explanation. The main upshot of our argument is that explanatory arguments from racial discrimination to realism about race fail. (shrink)

This paper compares the findings of content analyses of the corporate codes of ethics of Canada's largest corporations in 1992 and 2003. For both years, a modified version of a technique used in several other studies was used to determine and categorize the contents of the codes. It was found, inter alia, that, in 2003, as in 1992, more of the codes were concerned with conduct against the firm than with conduct on behalf of the firm. Among the changes from (...) 1992 to 2003 were a significant increase in the frequency of mention of environmental affairs, legal responsibility as the basis of codes and enforcement/compliance procedures. New computer systems of discovery create a research program for logic and philosophy of science. These systems consist of inference rules and control knowledge that guide the discovery process. Their paths of discovery are influenced by the available data and the discovery steps coincide with the justification of results. The discovery process can be described in terms of fundamental concepts of artificial intelligence such as heuristic search, and can also be interpreted in terms of logic. The traditional distinction that places (...) studies of scientific discovery outside the philosophy of science, in psychology, sociology, or history, is no longer valid in view of the existence of computer systems of discovery. It becomes both reasonable and attractive to study the schemes of discovery in the same way as the criteria of justification were studied: empirically as facts, and logically as norms. (shrink)

In this rejoinder to the critical comments elicited by my essay “Existential Hypotheses,” I propose to deal first with the challenge coming from the avowedly different philosophical outlook of Professor Churchman. My other critics, Professors Frank, Hempel, Nagel and Ramsperger, on the whole, share my basic conception of the tasks of philosophy of science and epistemology, even if they dissent in one important respect or another from the special solution I suggested. But since I discern even in Professor Nagel's remarks (...) a pragmatist or instrumentalist strain akin to the major contentions of Professor Churchman, it will be well to begin with a defense and further clarification of my underlying point of view. Only after this restatement of my platform will I undertake to defend semantic realism against the specific criticisms advanced by the last four authors. (shrink)

Intentions are an important concept in Artificial Intelligence and Cognitive Science. We present a formal theory of intentions and beliefs based on Discourse Representation Theory that captures many of their important logical properties. Unlike possible worlds approaches, this theory does not assume that agents are perfect reasoners, and gives a realistic view of their internal architecture; unlike most representational approaches, it has an objective semantics, and does not rely on an ad hoc labeling of the internal states of agents. This article argues that the chorus of elders in Sophocles' Oedipus Coloneus is far from ineffectual, as some scholars assume choruses of elders generally are, but exceptionally authoritative in its role as a chorus. The exceptional authority of the Elders of Colonus derives from their old age, wherefrom their sympathy for Oedipus obtains, and from the fact that they are Athenian and thus have the capacity to enact their sympathy for Oedipus by granting him special rights of residency as an (...) heroic protector of Athens. Detailed analysis of this particular chorus's speech, song, and action is helpful not only to our understanding of Oedipus Coloneus but also, more broadly, to our understanding of the ongoing, if not increasing, importance that the chorus will have maintained in ancient Greek tragedy. Dans les tentatives pour donner à la philosophie un fondement nouveau, le concept d’essence constitue le point central de la discussion, La phénoménologie de Husserl aussi bien que Feidétique de Scheler et de ses successeurs avait pour but de fonder, grâce à la doctrine de l’essence, une connaissance absolument certaine des vérités intemporelles. Cette prétention montre que la doctrine moderne de l’essence est la dernière étape de la pensée bourgeoise dont l’origine est la philosophie de Descartes. L’article se propose d’interpréter (...) les différentes conceptions de l’essence en tant que moments de l’évolution historique de cette pensée bourgeoise. La bourgeoisie dans sa période ascendante exigeait des vérités essentielles qu’elles fussent capables de se justifier devant la raison critique autonome de l’individu : au contraire la philosophie moderne fait de l’essence l’objet d’une intuition que la raison doit accepter telle quelle. Les tendances rationnelles de la doctrine de l’essence sont refoulées : la raison devient réceptrice, hétéronome. Cette démission de la raison critique reflète l’adaptation de la philosophie à l’idéologie antirationaliste des systèmes nouveaux d’autorité : dans la dernière phase de l’évolution, la doctrine de l’essence devient mythologie politique. Le positivisme représente l’opposition non dialectique à cette doctrine de l’essence : il veut entièrement chasser de la science le concept d’essence, mais du même coup il tombe dans le défaut de rabaisser tous les faits sur le même plan, sans établir entre eux de différences. Dans l’idée d’essence opposée au phénomène sont contenus des éléments positifs, critique de la réalité « mauvaise », processus de réalisation des possibilités aflxthentiques de l’homme et des choses. Ces éléments positifs, la doctrine dialectique de l’essence les conserve. — La deuxième partie du travail cherche à montrer la formation du concept d’essence dans la philosophie dialectique qui, grâce à ce concept, surmonte le relativisme sans retomber dans la métaphysique dogmatique. L’opposition de l’essence et du phénomène est conçue ici comme une relation historique, et dans la constitution de celle-ci les intérêts sociaux de la théorie pénètrent à titre d’élément constitutif. La praxis historique à laquelle la théorie est liée et qui doit supprimer (aufheben) l’opposition, rend les intérêts particuliers vraiment généraux et fonde un type nouveau de vérité universelle. Le concept d'essence qui est au centre de la doctrine dialectique et qui détermine tous les autres concepts est le concept de l’homme. Le souci d’atteindre l’homme véritable remplace le souci de connaissance absolument certaine qui caractérise la philosophie idéaliste. De même que les formes phénoménales de l’henime et des choses ont leur origine dans la structure sociale présente, ainsi cette structure dessine à l’avance l’image de l’essence et des possibilités humaines que l’homme doit comprendre comme des tâches historiques, dont la voie de réalisation est marquée par la réalité elle-même.During the last decades the concept of essence has been widely discussed in the various attempts to seek a new foundation for philosophy. Both the phenomenology of E. Husserl and the theory of essence of M. Scheler and his followers were devoted to discovering through their theories of reality the unconditioned and exact knowledge of eternal verities. This attempt characterizes modern theory of reality as the last stage of bourgeois thought which began with Descartes. — The article endeavors to interpret the various conceptions of essence as specific stages of the historical development of that thought. With the rise of modern society the demand was made that the essential verities justify themselves before the critical and autonomous reason of the individual, whereas contemporary theory regards them as objects of an intuition and believes that reason has to accept them in the way in which they manifest themselves. The critical and rational tendencies in the theory of reality are abandoned, reason becomes receptive and heteronomous. This abdication of autonomous critical reason mirrors the adjustment of philosophy to the anti-rational ideology of the new form of authoritarian state. In the last phase of development the theory of reality turns out to be political mythology. — Positivism represents the undialectical opposition to this theory of reality. It wishes to remove completely the concept of essence from science, but thereby arrives only at an indifferent levelling of all facts. The idea of reality as opposed to appearance contains the positive elements of a critique of reality and of the process of realization of the essential potentialities of man and things. They are preserved in the dialectical conception of reality. — The second part of the essay attempts to point out the function of the concept of reality in dialectical philosophy, with the help of which it overcomes relativism. The opposition between appearance and reality is here conceived as a historical relationship, in the determination of which enter as integral elements the social interests of the theory. In the course of the historical trend, with which the theory is bound up and which is supposed to abolish the opposition between appearance and reality, the particular interests become truly general, and a new kind of universally valid truth arises. Reality which stands at the center of the dialectical theory and determines all other concepts, refers primarily to the essence of man. Concern about concrete man is taking the place of concern about the unconditioned exact truth of idealist philosophy. In the same way as man’s (and thing’s) forms of appearance is grounded in the present social structure, likewise the idea of his essence and the process of its realization arise out of this structure, and its realization must be conceived as a historical task. "The Problem of Truth" is a philosophical book by Herbert Wilson Carr, who was a British philosopher, and a Professor of Philosophy. This book focused on unanalyzed experience as opposed to science. It focuses on the problems of truth which is simply regarded as the problem of philosophy.

Bobier and Omelianchuk argue that the Birth Strategy for addressing analogies between abortion and infanticide is saddled with a dilemma. It must be accepted that non-therapeutic late-term abortions are either, impermissible, or they are not. If accepted, then the Birth Strategy is undermined. If not, then the highly unintuitive claim that non-therapeutic late-term abortions are permissible must be accepted. I argue that the moral principle employed to defend the claim that non-therapeutic late-term abortions are morally impermissible fails to do so. (...) Furthermore, the principle that people have a right to bodily autonomy can be used as an argument for the conclusion that non-therapeutic late-term abortions are permissible and is intuitively stronger than the intuition for the opposite of this conclusion. This is because people having a right to bodily autonomy explains the impermissibility of rape and sexual assault. Consequently, the posited dilemma is defused and does not undermine the Birth Strategy. (shrink)

In this discussion note on Michal Pruski and Richard C. Playford’s “Artificial Wombs, Thomson and Abortion – What Might Change?,” I consider whether the prospect of ectogenesis technology would make abortion impermissible. I argue that a Thomson-style defense may not become inapplicable due to the right to life being conceived as a negative right. Further, if Thomson-style defenses do become inapplicable, those who claim that ectogenesis would be an obligatory alternative to abortion cannot do so without first showing that fetuses (...) have a right to life, something that Thomson assumed rather than argued for. I also include a discussion on ethical problems concerning what to do about children born from artificial wombs put there by those who looked to terminate their pregnancies because they sought to avoid parenthood. IntroductionInformation and communication technologies are becoming an integral part of medical practice, research and administration and their use will grow as telemedicine and electronic medical record use become part of routine practice. Security in maintaining patient data is important and there is a statuary obligation to do so, but few health professionals have been trained on how to achieve this. There is no information on the use of computers and email by doctors and nurses in South Africa in the workplace (...) and at home, and whether their current computer practices meets legal and ethical requirements. The aims of this study were to determine the use of computers by healthcare practitioners in the workplace and home; the use and approach to data storage, encryption and security of patient data and patient email; and the use of informed consent to transmit data by email.MethodsA self-administered questionnaire was administered to 400 health care providers from the state and private health care sectors. The questionnaire covered computer use in the workplace and at home, sharing of computers, data encryption and storage, email use, encryption of emails and storage, and the use of informed consent for email communication.Results193 doctors and 207 nurses in the private and public sectors completed the questionnaire. Forty (10%) of participants do not use a computer. A third of health professionals were the only users of computers at work or at home. One hundred and ninety-eight respondents (55%) did not know if the data on the computers were encrypted, 132 (36.7%) knew that the data were not encrypted and 30 (8.3%) individuals knew that the data on the computers they were using were encrypted. Few doctors, 58 (16%), received emails from patients, with doctors more likely to receive emails from patients than nurses (p = 0.0025). Thirty-one percent of individuals did not respond to the emails. Emails were saved by 40 (69%) recipients but only 5 (12.5%) doctors encrypted the messages, 19 (47.5%) individuals knowingly did not encrypt and 16 (40.0%) did not know if they encrypted the data. While 20% of health professionals have emailed patient data, but only 41.7% gained consent to do so.ConclusionsMost health professionals as sampled in South Africa are not compliant with the National Health Act or the Electronic Communications Transactions Act of South Africa or guidelines from regulatory bodies when managing patient data on computers. Many appear ignorant or lack the ability to comply with simple data security procedures. (shrink)

It also suggests that to evaluate the performance of a business the frame of reference has to be changed. This article provides empirical evidence of the social context and moral reasoning embedded within a parents’ decision to participate in autism genetics research. Based on in-depth interviews of parents who donated their family’s blood and medical information to an autism genetic database, three narratives of participation are analyzed, including the altruistic parent, the obligated parent, and the diagnostic parent. Although parents in this study were not generally concerned with bioethical principles such as autonomy and the issues of informed consent and/or (...) privacy and confidentiality of genetic information, a critical analysis reveals contextual bioethics embedded within these different narratives. These include the negotiations of responsibility that parents confront in biomedical research, the misguided hope and expectations parents place in genomic science, and the structural barriers of obtaining an autism diagnosis and educational services. Based on these findings, this article demonstrates the limits of a principle-based approach to bioethics and the emergent forms of biological citizenship that takes into account the social situations of people’s lives and the moral reasoning they negotiate when participating in autism genetic research. The development of the CRISPR/Cas9 gene editing system has generated new possibilities for the use of gene drive constructs to reduce or suppress mosquito populations to levels that do not support disease transmission. Despite this prospect, social resistance to genetically modified organisms remains high. Gene drive open field research thus raises important questions regarding what is owed to those who may not consent to such research, or those could be affected by the proposed research, but whose consent is not solicited. (...) The precise circumstances under which informed consent must be obtained, and from whom, requires careful consideration. Furthermore, appropriate engagement processes should be central to any introduction of genetically modified mosquitos in proposed target settings. In this work, international guidance documents on informed consent and engagement are reviewed and applied to the genetically modified mosquito research context. Five analogous research endeavours that involve area-wide / open field experiments are reviewed. The approach of each in respect to the solicitation of individual informed consent and community engagement are highlighted. While the solicitation of individual informed consent in host settings of gene drive field trials may not be possible or feasible in some instances, local community and stakeholder engagement will be key to building trust towards the proposed conduct of such research. In this regard, the approaches taken by investigators and sponsors of political science field research and weather modification field research should be avoided. Rather, proponents of gene drive field research should look to the Eliminate Dengue field trials, cluster randomised trials, and pragmatic clinical trials for guidance regarding how the solicitation of individual informed consent of host communities ought to be managed, and how these communities ought to be engaged. In Sophocles’ Ajax, a recurring conflict between two axiological systems gets thematized: the archaic, in which agonal values and personal excellence predominate, and the enlightened, which corresponds to the demands of already-developed cities and their values of equality and communal deliberation. This conflict is developed from a topic typical of the practical ideology of the time: the problem of measure and excess. The present work will account for the peculiar Sophoclean treatment of this problem through the analysis of the lexicon (...) in different passages of the work. As will be seen, characters as antagonistic as Ajax, Menelaus, and Agamemnon nonetheless concord in word choice when substantiating their decisions regarding how to act in situations of conflict. These words define common concepts typical of the archaic heroic code. On the contrary, other characters such as Tecmesa, the sailors’ choir, Odysseus himself, and Athena take different perspectives that are linked to enlightened demands._ _. (shrink)
